Terms Of Service

General

✦ Upon ordering a commission, you automatically agree to the terms of service.✦ You will only receive a digital file through VGEN or Google Drive, where you will be able to download your artwork!✦ If your OC has tattoos please provide the Tattoo's PNG in the Upload section. I wont be making highly detailed tattoos unless a fee is paid, the fee depends on how detailed ur Tattoo is.

PAYMENTS

✦ I accept:-- Paypay | Stripe | Zelle | Apple pay [ or ] Vgen✦ If there are any complications with the payment or any confusion on the prices please contact me at any moment throughout the process!

PAYMENTS PLANS

✦ Mostly will be done for VTUBER Models and bigger commissions nothing under $150-$200 -✦There will be 2-3 payment plans, for the commission to be started/ marked as WIP at least half the payment should be done, for the FINAL PRODUCT to be delivered the Full Payment should be done, Im usually in no rush for payment and you can take your time on making the payments, if there is any complications with payment I wont stop production because of it unless you believe the commission should be postponed.

REVISIONS

✦ I will be giving updates throughout the process, you can say as many changes as ud like during the sketching/brainstorming phase, and throughout the process im mostly okay with feedback. However don't try to change my art style.✦ If I am working on your commission and I finish it before you answer back I will not change the entire result so please make sure you have good communication in time, once the final product is given only small missed details can be fixed.✦ I want you to feel happy with the results so please let me know in time for any adjustments!

DEADLINES AND DELIVERY

✦ I will mark the Guaranteed Delivery date to 4-5 months if you select No Deadline; however the commission might be finished way before that, I just dont like the pressure & stress deadlines bring on me.✦ Rush fee will be applied if you request so!✦ I like doing every commission in less than 2-5 days, it just takes time to get to it.

USE

✦ Unless stated otherwise, the commission is for personal use only (Streaming/Referencing)✦ You can't re-sell the artwork.✦ I reserve the rights to the artwork and distribution. Please credit me when posting the art.✦ I may use this artwork for portfolio, resume, or advertisement needs.✦ I might post work in progress on my social media. If you want the piece to be made private, please notify beforehand.✦ No artwork is allowed to be utilized to fund or support Artificial Intelligent databeses, for NFTs or other crypto-currency.✦ Do not make changes to the Art without letting me know, its rude.

AI USAGE & COPYRIGHT TERMS

By commissioning artwork from me (the Artist), you, the Client, agree to the following terms:

✦ Prohibition of AI Use:You are strictly prohibited from uploading, inputting, training, or otherwise using the commissioned artwork, in whole or in part, in any artificial intelligence (AI) system, dataset, generator, or related technology. This includes; creating videos/animations of the Commissioned Art since you have to Upload the Artwork to an Ai.

✦ Copyright Ownership:All copyright and intellectual property rights for the artwork remain solely with the Artist (Me, Massi.) Payment for a commission does not transfer or assign copyright ownership.

Paying for the commission only gives the buyer a license to use the finished artwork. It does not transfer ownership or copyright.

✦ License of Use:The Client may use the commissioned artwork only for personal or agreed purposes. They cannot copy, sell, edit, or claim it as their own.

✦ Third-Party Payments:If another individual or entity pays for the commission on your behalf, these same terms fully apply to you as the end user. Payment by a third party does not grant them any ownership or usage rights.

REFUNDS

✦ Refunds will be done Partially or Fully depending on the progress of the commission.This is because my time and effort still go into the work, even if it isn’t finished or you are not fully satisfied, taking or working on your commission reserved a slot that could have been taken by another paying client.✦ If a refund (partial or full) is issued but I had already delivered, I kindly ask that no review be left, since the transaction has been mutually resolved.

✦ If I cancel:
- I have the rights to cancel a commission anytime without having to provide explanation
- I have the right to use the WIPs on my socials or as showcases ( Unless you payed the privacy fee)✦ If you cancel:
- You lose the right to use, post, or keep any part of the artwork (wip pictures)
